These terms apply to your use of the website at bopm.co.uk ("the site"). By using the site you agree to these terms. If you don't agree, please don't use the site. These terms don't affect your statutory rights as a consumer.

Our Privacy Policy and Cookie Policy explain how we handle your data. They sit alongside these terms — agreeing to these terms is not consent to cookies or marketing, which we ask for separately.

What BOPM is — and what it isn't

BOPM helps you find toys and games across UK retailers. We show you prices, delivery costs, stock, and ratings so you can decide where to buy.

What BOPM is not:

• We are not a retailer. We don't sell toys, hold stock, or take payment for products. When you click through to a retailer and buy something, your contract is with that retailer, not with us. Their terms, prices, delivery arrangements, and returns policies apply to your purchase.
• We are not a party to your purchase. Your statutory rights under the Consumer Rights Act 2015 — goods must be as described, of satisfactory quality, and fit for purpose — sit with the retailer you buy from. Any cancellation rights under the Consumer Contracts Regulations 2013 are exercised against that retailer.
• We are not an agent for you or for any retailer.

Using the site

Anyone can browse the site. To create a BOPM account you must be 18 or over and live in the UK.

You agree not to:

• Use the site for anything unlawful
• Scrape, harvest, or systematically extract data from the site, whether manually or with bots, crawlers, or similar tools, except as permitted by a search engine's normal indexing
• Attempt to gain unauthorised access to the site, its servers, or connected systems
• Interfere with the site's operation, including introducing malware or placing unreasonable load on our infrastructure
• Misrepresent your identity or affiliation
• Use the site to send spam or unsolicited communications
• Copy, frame, or mirror the site or any part of it without our written permission

We may suspend or withdraw access for anyone who breaches these terms.

Prices, stock, and accuracy

We work hard to keep prices, delivery costs, and stock information accurate, and we refresh our data from retailers regularly. But this information comes from retailer feeds and can change between our last update and your click.

• Prices are correct at the time of your click-out to the best of our knowledge — always check the final price on the retailer's site before you buy. The retailer's own price at their checkout is the one that applies.
• Where a retailer provides delivery costs, we show the total price including delivery so you can compare fairly. Where delivery information isn't available from the retailer, we say so.
• Each product page shows when its prices were last updated.
• Stock indicators reflect the retailer's feed at our last update and are not a guarantee of availability.
• We are not responsible for pricing errors, stock errors, or changes on retailer sites, and we don't guarantee that any price shown on BOPM will be honoured by the retailer.

We never accept payment from retailers for better placement. Our ranking and ordering of results is independent — see section 5.

How we make money

When you click through to a retailer from BOPM and buy something, the retailer may pay us a commission. It costs you nothing extra — the price is the same whether you arrive via BOPM or go direct.

Retailer links on the site are marked as affiliate links in line with advertising rules.

Intellectual property

The BOPM name, logo, branding, site design, and our original content belong to Buy Offer Play Marketplace Limited. You may not use them without our written permission, except to link to us fairly and lawfully.

Product names, images, descriptions, and trade marks shown in search results belong to their respective owners (retailers, brands, and manufacturers) and are used under licence via our affiliate network agreements or as otherwise permitted. Nothing on the site grants you any rights in them.

You may use the site for personal, non-commercial purposes. You may not republish, resell, or redistribute our data or content.

Availability and changes

We aim to keep the site available and working well, but we don't guarantee that it will be uninterrupted, error-free, or that any particular feature will always be available. We may change, suspend, or withdraw any part of the site at any time, including the products, categories, and retailers covered.

Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of England and Wales.

Subject to that:

• The site and its information are provided for general information to help you compare and discover products. We are not liable for losses arising from your reliance on price, stock, delivery, or rating information shown on the site — always verify on the retailer's site before purchasing.
• We are not liable for the acts, omissions, products, services, or websites of any retailer or other third party we link to, including their pricing errors, delivery failures, or product safety issues. Claims about a purchase belong with the retailer under your contract with them.
• We are not liable for losses that were not foreseeable to you and us when you started using the site, losses not caused by our breach of these terms, or business losses (the site is for consumers acting in a personal capacity).
• We are not liable for events outside our reasonable control.

Third-party links

The site links to retailer websites and may link to other third-party sites. We don't control them and aren't responsible for their content, accuracy, or practices. A link is not an endorsement. Check any site's own terms and privacy policy before using it.

Changes to these terms

We may update these terms from time to time — for example when we add features or the law changes. The version number and date at the top show the current version. If we make a material change, we'll post a notice on the site for a reasonable period. Material changes won't apply retrospectively. If you keep using the site after a change takes effect, the updated terms apply to your use from that point; if you don't agree with a change, stop using the site.

General

• If any part of these terms is found unenforceable, the rest still applies.
• If we don't enforce a right straight away, we haven't waived it.
• These terms are between you and Buy Offer Play Marketplace Limited. No one else has rights under them (Contracts (Rights of Third Parties) Act 1999).

Governing law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that if you live in Scotland or Northern Ireland you may bring proceedings in your local courts, and nothing in this clause takes away rights you have under the consumer law of the part of the UK where you live.
